>> every day, hard-working people make a sacrifice to make a payroll, create jobs. what i said was that we need to stand behind them, as america always has. >> sean: that was the president in a new ad, trying to undo the damage of his ridiculous "you didn't build that comment." now his answer is to blame mitt romney for taking him out of conference. the rnc decided to put the president back in context in a set of new ads and let's just say tdoesn't look like mitt romney twisted the president's words at all. let's roll on the ad. >> okay, fans. let's go to the fumble of the week. barack obama drops the ball at the one yard line. >> if you have a business -- you didn't build that. somebody else made that happen!

9:15 pm
are still frustrated with because they look at lim and they say, his record on the deficit, his record on the debt, his record on the jobs and the economy, but when he looks straight to camera, it works. >> sean: well, but the president goes on to say that, you know, our plan worked. if this is what's working, we are really in deep trouble. all right. the rnc has another ad. let's roll there and get your professional opinion. let's roll this. >> if you have been successful, you didn't get there on your own. you didn't get there on your own. i am always struck by people who think, wow, it must be because i was just so smart. there are a lot of smart people out there. it must be because i worked harder than anybody else. let me statistical tell you something, there are a whole bunch of hard-working people out there. if you were successful, somebody along the lines gave you some help! there was a great teacher

somewhere in your life. somebody helped to create this unbelievable american system that we have that allowed ow to thrive. somebody invested in roads and bridges. if have you a business, that -- you didn't build that. somebody else made that happen. >> the republican national committee is responsible for the content of this advertising. >> sean: that's it. no suppliesing, no dicing, in context. >> that's a better ad because it's barack obama's words. in the testing we have done, two things matter t. has to be an issue that you care about. for small businesses owners and people who believe in the american dream and the idea that cusackifies and work hard and struggle and get ahead, that ad appeals to them. and the second thing, it's barack obama's words themselves. you can't run away from it. you can't edit it. so the rnc ad is one of the best ads i have seen so far. >> sean: think about what he is

9:18 pm
we are looking at the economy, it is getting worse. in the interviews i am doing in oh and michigan and north carolina, florida -- they are more afraid, not less afraid of the future. they believe that washington can't necessarily add jobs. but they can stop wasteful washington spending. >> sean: all right. we saw in the latest poll that the blaming bush tactic doesn't work. the president's saying that -- our plan -- it worked. and america's coming back. we fixed the economy and people respect us. there is a new attitude in america. that's want going to work. negativity hasn't worked. what is he left with, at this point? >> he is left with trying to destroy mitt romney. -- so far that, hasn't worked. >> he has maintained a narrow lead-- yeah but that nbc poll skews 11 points democrat. >> in every survey, basically obama has a 1 or 2-point lead. >> sean: abc poll, 9 points,

they outsourced democrats. >> more people do identify themselves as democrats than they do republican. >> sean: 40% is conservative. >> we don't disagree on that. but we would agree, it's a dead heat. and the only way that barack obama sees a path to the election is destroying mitt romney. so it's up to mitt romney and his campaign, to speak up, to fight back, to be specific. to draw the contrasts and not sit back and be a punching bag. by the way, if you want to do one of these focus group it's. >> sean: let you yell at the people. >> on fox news, go to luntz global dot-com. >> sean: and you yell at them. >> and they get paid and they get a clans to have their voices heard. it's actually your voice and the american people? >> i am just kidding you, of course. but do you yell a little bit. a classic "hannity" shootout. michael bloomberg floats the idea universal nationwide

>> sean: tonight erups in anaheim, california. rioters have taken to the streets, damaging storefronts and setting fires and hurting bottle police. the rioting started after two deadly shootings by police. a gang member was killed after running from authorities and the violent protest after a second shooting on sunday when joel mathew also reportedly, a gang member, was shot and killed while firing an an officer. we have learned that federal officials will review the shootings. joining me is the former lapd detective, mark fuhrman. i know we are having an audio problem. thanks for using your phone. as we look at the video, let's
9:57 pm
talk about what happened and what is unfolding there. >> lyou know, sean, what is interesting about this is just how you describe these shootings. have you two gunning membersn involved in both of these shootings and i think people are passing over the conduct that gangs are involved in -- violence, drugs and other violent crimes. so to have the police interact with them is not shocking and have them engaged in a deadly encounter is not shocking whatsoever. but everybody's just kind of blowing over that fact. it's disturbing. >> sean: one of the problems we have in almost every case, mark, and i wasn't there, you weren't there and nor were the people who are rioting. there is always, it seems, a rush to judgment. and nobody wants to give the time to allow the facts to come in. >> well, you know, sean, this is an opportunity, this is an opportunity for the average
9:58 pm
person who has an ax to grind with authority or the police or whichever authorities that -- that they have a problem with, this is an opportunity to keep the police off balance, to actually maybe exert pressure on politicians and administrators who will rush in and have somebody, you know, review the cases and rush in and try to appease irrational people, they are not rational, they are criminals right now. they are not acting under constitutional rights to assemble. they have gone over that. they have become criminals. they are assaulting people. >> sean: let me ask you a question on that front. whenever these incidents happen, we have all of this videotape, we can identify many of the people who are involved. there's an example, you can see people on video, committing crimes. we never go back and review the videotape and arrest the people we know committed crimes in these instances. why don't we ever do that? >> we do do that.
9:59 pm
lapd did that. in the 80s, we had a lot of demonstrations in the early 90s, we did exactly that. we had people in the crowd foeoing, we had people in buildings and other locations-- yover hear about it. >> yes, we did do that. you don't hear about it because, you know, it is publicity that the media doesn't want to cover. you know, you have these -- insiders, these anarchists that come from outside areas to actually fuel the anger that might just be frustration and anger and some kind of connection that people have with the suspects in these shootings. but what you have is people just inciting -- throwing fuel on the emotional fire that's going. they do this and that's who we try to identify. you try to identify them at the riots, at the demonstrations. and snatch them right then. that's what they should be doing. they should be more
